Hi,
Recently made a speculative claim on PPI through a CMC. I didn't think i had any PPI and made a point not to take out the product. I was a little shocked to find out that my credit card (from 1988) and 2 store cards managed by Abbey National (now Santander) both had PPI added. These were without my knowledge. I recently received a letter from Santander upholding my complaint on a store card PPI taken out in 2004 but have not upheld my claim for one taken out in 1999. They claim it has gone over 15 years and as such is time barred.
My question is this.... If i was unaware the product had been added how can a time bar be a justification not to uphold the complaint? They agree that the ppi was sold (on the agreement where they have upheld my complaint) when my circumstances didn't warrant it but as i wasn't asked if i wanted the product then there would have been no suitability questions asked that would lead to their judgment to uphold the complaint.
To be fair the calculation of repayment on the product where they have upheld my complaint is in line with expectation but i need advise on next steps on the rejected claim.
Regards
