  • Suing someone in small claims

    Hi all
my first post - i’m suing someone using the small claims track with a hearing date in December. The defendant only has one main asset and little else. I believe he will sell this asset and try to hide it from the court. Can I stop him selling this asset and how?? Claim is around £16000 although it has still been allocated to the small claims track. Any advice would be welcome

Depends on the asset - moveable or immovable?

        To reply to the questions
the asset is very moveable, it’s a car and worth £10,000+
my concern is that it will be sold and the money will just vanish before we get to a hearing

Is the car part of the claim?

Thank you EFPOM. The car isn’t part of the claim which is for the repayment of monies loaned. I had previously read about freezing orders but sort of dismissed that route as it was saying they are very expensive to set up. Any idea how much a freezing order would cost as I don’t want to throw good money after bad??
