  • Small Claims - preliminary hearing

    Hello,
    The county court has sent me a letter saying I may not have a case against the company I’m suing through the small claims. How likely is the the judge to award the defendant legal costs if I drop the case? I tried to mediate but they refused. Their solicitors offered me a save as to legal cost offer instead as they said I had no case. It now seems like the judge agrees with them. Should I just drop it and hope for the best? All replies very gratefully received.

    Post up your particulars of claim.
    Post up the correspondence you got from the court.
    If you "drop the case" an award of costs against you is a certainty.
    Has you claim been allocated to the small claim track?
