  • CCJ Deed of Trust

    My credit report recently changed suddenly and a CCJ Deed of Trust(Scottish Law)? Has been applied to a debt I've never been able to reach agreement over. And no Court paper work was received by me. There is already an attachment order on a property under joint ownership for a debt now 12 years old which is still unresolved. What can I expect to happen now as both companies involved have shown no interest in accepting an affordable payment impossible now due to being unemployed.

    Are you in Scotland ? ( or were you when the contract was entered in to ?)

    What kind of debt was it? approximate outstanding amount ? and what is the dispute over? (ie is it actually a dispute or simply it became unaffordable and they won't accept affordable payments? )

    How did they get an attachment on your property or has it been secured since entering into the contract ?

    Have you moved recently ( and not informed the companies involved ) ? when was last communications you had with them ? last time you paid anything?

    I'm sure a Scots Trust Deed is like the IVA here, so an insolvency process but you would be involved in setting that up and it would be across all your debts not just one ... so possibly a Deed of Trust could be related to the security on the property but then I don't know why it would show on your credit file, and why now if this is a 12 year old debt. Any chance of a screenshot of exactly what shows on your credit file ?

      Hi, I am still around Amethyst - just been busy. I think the first step here is to understand if this is a court decree (CCJ) for a debt or perhaps a sequestration. If its possible to clarify that would be the first step. I think you can upload documents here but of course you need to black out any personal details.

        The contract was in England.

        I believe it's a disputed BT account(took hours to find paperwork)as it's now over 7 years old. No final bill issued so I wouldn't agree to pay it. But several different amounts have been stated in writing. Becoming unemployed 6 years ago due to Redundancy made payments unaffordable. The amount has never been confirmed several letters said £1,250 others said £300.

        A previous Credit Card debt (12 years old)has an attachment order the Bank only confirms an Application was sent to them. I believe that was £1,200. Which I couldn't afford to pay. I did attempt payments voluntarily by standing order but the Credit Card Company refused to deal with me. Despite being informed from the beginning of financial difficulties. I believe passed to Lowell who briefly contacted me about these matters then went silent for 2-3 months ago and haven't provided proof of claim.

        I still reside at the same address 12 years now.

        There are defaults listed for these 3 accounts. But also states Credit Card accounts are closed.

        I've filed disputes as yheaccount information for BT is not correct but the address is.

          The Telecoms account (BT) is listed as CCJ Deed of Trust which I thought was Scottish Law or is BT registered in Scotland? The service provided was in England not Scotland. Northampton Court was sitting I knew nothing about it till a notification on a change to credit report.

            Apologies for the vagueness I hope I've clarified it a little better. Citizens Advice basically told me it's your problem there are others in more need. And wouldn't help.
