    I have recently accepted a part 36 offer for the equity share in my property.

    My ex is buying me out however there was a number of issues and claims with the builder which I am fully entitled to.


    Question

    1. Is a Declaration of Circumstances and Authority to Proceed require in order to complete the transaction? Or just a TR1


    2. As the part 36 was only the equity share even when I sell the property to my ex am I entitled to the various claims in full?

    On 1 - I assume the Authority to Proceed is from your solicitor to you. If that is right, then you need to discuss that with your solicitor. The same holds for your 2nd question to do with the builders.
