  • Charging Order but company who registered 10 years ago are now dissolved

    Hello,

    We are trying to secure a second mortgage on our home and we have an old charge of approx £1600 on the property from a debt in 2008.

    The company that that registered the debt - Phoenix Recoveries no longer trade and companies house say they are dissolved. Our lender will not now proceed any further until we have it removed.

    Any help what what we should do next.

    BVD is the only party able to release the charge. Land Registry require a DS1 from BVD

      Do you know which solicitors acted in the claim?

      Phoenix were a Luxembourg company and acted through third parties here - the solicitors are your likely first point of call for having the charge removed - may be Mortimer Clarke ? If you have any documents it should say - they may have done the charging order application too ?

        Hello, they have sold this debt on apparently and then it’s changed hands lots of times too. I am now being asked to get a copy of the original charging order, do you know where this can be applied for?

        Last company we know that had the debt was Arrow Global in 2015 and they sold it to Allied International Credit UK Ltd who now say they have no records of that debt with them and neither do Arrow Global.

        Looks like we are a bit stuck here.

          Hello, we have been asked to supply a copy of the original charging order but I am having difficulty finding out where to do this or order it from.

          Any help would be great.

            Sorry to hijack the thread but is it Phoenix Recoveries (UK) Limited s.a.r.l that is dissolved or Phoenix Recoveries (UK) Limited or both and if so does anyone have the date when s.a.r.l was dissolved

              If you want to register your company you need to go to Company Registration Services, to provide a legal service by a legal adviser.
