I hope you’re well. I have recently signed up to Legal Beagles after receiving an invoice from Audi Finance requesting payment for excess mileage for more than £2,000. I have been reading many of the posts over the last couple of weeks and found them really useful but have found they are all slightly different. I've included below a summary of the position I am in and also my proposed response to Audi Finance. It would be great to get your views.
In 2016 I took out a Hire Purchase Agreement with Audi Finance on a 48 month term. My intention was to keep the car for the duration of the term but I wasn’t sure about the annual mileage. However, the salesman in the Audi dealership notified me of the Consumer Credit Act 1974 and the ability to give the car back once I had paid off at least half of the finance and not be liable to any excess mileage charges. I got to the stage where I had paid off at least half of the finance so I recently decided to go through the process of VT and take out a new finance agreement with Audi on a different car. The process of notifying Audi Finance and having the car collected went well. However, I have received a letter from them requesting over £2,000 due to Excess Mileage charges. I don’t believe I am liable to these charges under the CCA 1974 and will therefore be challenging this. I have attached a letter that I propose to send to Audi Finance.
It would also be great to hear from anyone who has successfully challenges excess mileage fees and been successful.
