I have my case next month and whilst I've just about managed to keep up with the proceedings etc. I had a great deal of difficulty getting emails from my old employer, I've made all the statutory requests and been as specific as I can but the recently replied saying they've either been lost of deleted. They knew that I was going to take them to tribunal within a week of my dismissal so I would have thought they would have kept them safe.
Anyhow. Following my dismissal, I obviously gave the company all their tech back, phone/tablet etc. Packed my work stuff up at home and there it sat for some time until I found another job. In between leaving and starting a new, we had a flood and most of the items in the sitting room and dining room was packed up and put into storage whilst the floors dried up, then the decorating, new carpets and so on.
The work was all finish a month or so back and whilst getting everything out of storage I found my old laptop, it was only then that it dawned on me that the laptop would have a copy of my emails, unfortunately not a full copy, but enough to help me prove some of my case.
Given that the company knew that I used my own computer, accepting that a tablet wasn't the best for writing emails ect. would I be able to use/submit this information as evidence.
To confirm. I wasn't, by far, the only one that used personal tech, phones, and laptop use within the company was quite the norm, in fact the head of IT loaded the email, and others systems onto the machine for me.
Given that I didn't intend to retain the information after my dismissal, can I use this?
Any information or advice you could give me would be wonderful.
