I'll try and keep this as short as possible, I'd really appreciate any advice on this!
I was employed from 2012 to December 2018 with a UK company that went into administration at this point. I left the UK in April 2016 to work remotely from Ireland. The company had payroll through an Irish company but I was still employed under UK law but importantly not paying taxes in the UK.
When the company went bust the UK employees were told to apply for statutory redundancy through the UK govt, of course because I was in Ireland I could not do this. Instead I applied to the Irish government, ended up having to go to the workplace relations commission (WRC) for a mediation hearing. They ruled in my favour for redundancy, notice period and unpaid wages. The company is no more, administrators came in and did not contest the decision.
The administrators are still sorting through the debts trying to wrangle some money for creditors. They've said employees will be due whatever they can get but said it will be only a few hundred quid. I would be due far more than that based on the calculations of the Irish government statutory payouts.
The WRC decision is really only applicable in Ireland, I'm pretty sure they can't enforce anything in the UK. The adjudicator in the WRC mentioned that there is some insolvency fund that I could apply to should the company/administrators fail to pay the amount I'm due - what would be the best way to go with this? It's been difficult to get advice in Ireland as most solicitors know Irish law and not the UK law.
