  • Highview parking charge notice received 15 days after incident

    Hi guys I知 just posting this as I知 in need of abit of information and guidance I just received a parking charge notice from Highview parking for parking on private land. However the incident occurred on 01/08/19 and I have only just received this letter on the 16/08/19 even though the date of notice on the charge notice is 13/08/19 I was wondering if this would be classed as 14 days after the incident took place as it takes time to come in the post. Any information on this will be appreciated.

    You can use failure to deliver within 14 days, they will not be able to prove when it was posted.
    You can also use failure to give warning of keeper liability 9 (2) (f), failed to give the invitation to keeper 9 (2) (e), failed to identify the creditor 9 (2) (h).

    Probably best to use failure of 9 (2) (f) as there is no room for argument then throw all of them at POPLA

          So they know they have failed and can only chase the driver, and they are asking who that was. Just ignore and wait to see what comes next
