I live in a Coach House style property over garages.I am being taken to court in less than 8 weeks time by a management company who say i have breached the terms of my lease by not paying Buildings Insurance for the last 2 years.
I have refused to pay it beccause i bought the freehold in May 2017 and i believe it is my responsibility to insure the property and not theirs.
I have been told by The Land Registry that i am indeed the Freeholder but that i also have Leasehold Titles attached due to two of the garages which belong to other homeowners.
My solicitor who acted for me believes i should compromise with the company and make them an offer to settle before going to court as he thinks i may lose.
I am totally against doing this as i still believe i am in the right. why would i still have a Lease at all as the Freeholder.
If i had broken the terms as a Leaseholder then they could have gone to court to repossess the property yet they have chosen not to. I believe this is because they actually know they can't as i am not a Leaseholder yet they are taking me to court for £2000 in costs. Can anyone help with my dilemma.
