  • Help with Old DEBT

    Hello all

Im looking advice on old debts from 2007/8

I had to mbna cards with 5k in total 3400 /2600 between two of them witch when i was payed off due to recession 2008 fell to default. Roll on 2019 id forgot all about these and when checking credit record not there. Then in may two dirrent collection agencies wrote demanding payment .However i know that statue barred is 6 year and these must either be or very close as i payed nothing to them going by bank account 5 year but am unsure of last payment which was a token payment.

I have requested CCA for both and one returned a small slip poor quality signed with 3 lose a4 wordprocessor sheet saying terms. The other has not returned any thing and over there time by a month. The Signed 2005 cca has a ppi ticked and i do recall insurance on virgin to clear balance due to unemployment but this failed to happen as they only payed 12 month payments they refused to clear debt.I also during that claim year i had to pay ppi to keep the claim active i was told ..30 quid a month at the tim ,and when they failed to clear the balance was told i could not reclaim other 12 month payment after my first claim.

There request for transaction history was 3 sheets called a mbna log which seemed to be edited to one side so unclear about charges ,fee and ppi.

Sould i request a Sar? and the term of the cca seem lacking

    Any advice please .Thanks

Let sleeping debts sleep .Unless a debt collection agency etc have been in contact demanding payments ,leave them where they are (in the past).

Weird - I'd guess that was just a spammer so I'll remove the post.

You've received one of the agreements following cca request - Best thing is to post a pic of the agreement ( redact personal details) to see if it's compliant. Have the dca threatened court action ?

There are two accounts - both originally MBNA cards - different debt collection companies and neither is at court stage or letter of claim as yet ?

Was one a Virgin card ( with the PPI on?) - have you made a formal complaint about the PPI as it didn't act as you expected it to when you tried to claim on it.

SARS would be a good idea to find out what happened with them. To MBNA and possibly Virgin?
