    Hi All ,
    I really do need an urgent help and advice. I received a claim form from Northampton County Court dated on the 9th of July 2019 and I filled and submitted the Acknowledgement of Service on the 17th of July 2019 back to the courts ,which means i have until the 12th of august to defend the claim and return it back to the courts . On the 17th of July I also received another letter from Lowell Solicitors notifying me of the Notice of Claim Issue, I have been soo stressed since i received the court claim that I decided to phone Lowell Solicitors to negotiate for a payment reduction just to get this problem off my head, but they insisted i should pay the whole outstanding debt including interest and court fees of £2039.44 .
    For clarity this is the Particulars of Claim from Lowell Solicitors
    1) The Defendant entered into a Consumer Credit Act 1974 regulated agreement with Vanquis under account reference 402xxxxxxxxx (the Agreement).
    2) The defendant failed to maintain the required payments and arrears began to accrue.
    3) The Agreement was later was later assigned to the claimant on 04/08/2013and notice given to the Defendant .
    4) Despite repeated requests for payment the sum of £1,717.07 remains due and outstanding .
    And the Claimants claims
    a) The said sum of £1,717.07
    b) Interest pursuant to s69 County Courts Act 1984 at the rate of 8% per annum from the date of issue accruing at a daily rate of 0.376, but limited to one year , being £137.37
    c) Cost.
    What should i do now ,help please can't afford to have a ccj registered in my name .

    So when was the account defaulted? The debt was assigned to them on 4/8/2013 so they have squeezed in 3 weeks before the debt was statute barred if it was defaulted at the time they bought it. The original debtor probably probably defaulted it well before they sold it so your debt is possibly/probably statute barred and you don't need to pay it. Tell Lowell that the debt us statute barred. Also SAR to the original creditor asking for all documents pertaining to you.
