    Thanks again for all your help.

    I have received an email from the defendants legal counsel.

    Below is what they have written to me. Would it be possible to let me know the best way to respond to this email. I thought that my contract was with the dealership.



    Re: Dacia Sandero (reg XXXX XXX)


    We write on behalf of our client in relation to the above.


    Our client advises the insurance write off value is closer to £4000 and we suggest you negotiate an improved settlement with Dacia given their admission of liability.


    Thank you for providing evidence of the vehicle’s current mileage.

      Dear Sirs
      P**s off.
      My claim is against your client as he was in breach of contract by selling a vehicle which was unsatisfactory and unfit for purpose.
      I suggest you recommend your client settles before I initiate court proceedings as that will inevitably increase the amount payable.
      Unless I receive a response I deem satisfactory (ie offer of a full refund) by 4.00pm on Friday 06 September I shall proceed to initiate court action without further reference to either you or your client.
      If he wishes he may pursue the warranty company when he retakes possession of the vehicle.

        Thank you for your reply. I will send them an email to clarify that the dealership was in breach of contract and I would like an refund.

            Just an update on what has happened.

            On Tuesday I called Citizen's Advice to find out what was happening with the complaint I made to Trading Standards as the dealership was a member of their 'buy with confidence' scheme. The adviser at Citizen's Advice forwarded all the information to a Senior Trading Standards Office who has done some mediation. The result being is the garage is going to refund the difference between the price Dacia have given for the vehicle and the purchase price of the vehicle minus the mileage I have done @ 40p per mile.

            It appears to be a fair conclusion to the problem without the hassle of proceeding with court action.

            I just wanted to say thank you for all the help that has been given on this forum particularly from DES8 it has been really appreciated.
