Hi, sorry I am new here but really stuck with something and need some advice please.
I had a car with Mercedes for 4 years and when due to return it they said I was over my mileage which I agreed with. The sales person told me it would cost £2K to return the car to cover the cost of the mileage and leave or I could pay £2K as a deposit for a new car and not have to pay anything on the old car as I will be signing a new 4 year contract with them.
I had to pay £2K regardless so was happy with this. I returned the car, paid £2K and got a new car on finance with Mercedes. 30 days later I received an invoice for £2.5K for damage and excess mileage.
I called the sales person at Mercedes who did sound surprised and asked me to send the invoice so she could discuss with her manager. I asked her to send me a copy of the damage report I signed showing no damage when I returned the car (the car was immaculate and they even told me that)!
I then received an email back from the sales persons manager at the branch to say they agree there was no damage on the car when it was returned so I can dispute that with the finance company (this formed around £500 of the total £2.5K). HOWEVER, in regardes to the mileage, they have spoken to the sales person in question who has denied the agreement was made. They then said if I cannot prove the sales person told me this I will have to pay.
It is now her word against mine (and my partner who came with me). I did not at any point think that I would need to get her to put this in writing as I thought this was standard stuff for them. I signed an agreement which shows I paid £2K upfront but it didnt disclose what this was covering. When signing I asked again and she again made clear the £2K covered the new and old car and there would be nothing more for me to pay (except the new monthly rental cost). Now she is completely denying any of these conversations and has managed to get me locked into a new 4 year contract.
I have raised a compliant to the finance company who are telling me to discuss with Mercedes and Mercedes are telling me to discuss with the finance company who are saying I need proof. I am really stuck and feel this is morally wrong and dont know where to turn next. Please help!
