  • Ccj for the same debt 7 years later

    Hi.

Long story short. I didn't pay a phone bill from Vodafone because they royally ripped me off. Anyway the debt past to lowell solicitors. Letter after letter I finally get a cjj. This is 2012. Early last year the ccj came off my credit report. Anyway I continued to get letters from them every few months until this month i checked my credit report and I've just had another ccj from lowell for the same debt (plus £200). So I rang them and said it's been of my report because it's been over 7 years since I first got it. They said my facts are wrong and I paid something to them in 2015 which is a lie. I asked for proof they said they dont need to give it. I asked for proof they even know want the debt is for. They said they dont have to. Where do I stand on this?

Do you have any evidence of the previous CCJ? Any previous letters you've kept that referred to the CCJ or contained the claim number?

Do you know who the judgement creditor was for that CCJ? Was that Lowell as well ?

The CCJ will exist still despite being removed from the judgment register - they cannot bring a new claim for the same debt - only apply to enforce the original judgment.

What are they saying you paid in 2015 ?
Have they actually got a Judgment in Default against you for this recent claim or have you just received a claim form ?
