Hi i reversed a direct debit due to my son was signed to a local football club last year in September and due to issues which came about within the season i decided to reverse the payment due to i don't think that what my son got for the payments we made wasn't what was promised by the club.
the club are claiming that i have committed fraud by pulling back the direct debit and threatening to use the fraud act 2006 and have given me 5 days to pay up before they take me to small claims for the money.
my son had a few issues very early into the season and the manager started to use it as a way to single him out and started to not only bench him from teh start of every game but if he got any time on the pitch it was lucky if it was 10 minutes of a 70 minute game.
There was issues where the manager was taking younger players that under fa rules and league rules are not allowed to play not only this but it would void any insurance that was covering any of the players while ever these younger players was on the pitch and also while these players was on the pitch my son and another lad was loosing game time.
then there was issues with training where the manager kept changing training times and making the players join training sessions where the u11's and u13's joined together now they still only had the same manager and the same space to use for training but twice as many children and not the original agreed time that was set at the start of the season. so not only was my son not getting the correct amount of time on the ball he was sharing his training pitch and having to not train to his full ability as he had to hold back so he didn't hurt any of the younger players.
i have a statement from another parent who has been in the same position with the manager and the club and their son felt the same that they had been singled out and not given game time due to the manager was singling them out based on there body size. my son gain a bit of weight due to some depression issues and he had to have surgery which put him out of action for a while this is what the manager used against my son.
the club are trying to use he was an active player as they have just listed games he played in now the issue i raised is that even though he may have attended the games they have no way to show he played in each and every game not only that but due to how the manager has used u11s in a u13s game the manager will have had to lie to the league which is where the results and players attendance is recorded which is what the club is using, i have proof of this happening on at least 2 occasions as the manager used to put it in message and so i have screenshots of the manager saying that's what she is doing.
i just wondered if anyone could give me some guidance on what is my best option and route on this and is there anything i can write back to them before they start court action I'm not afraid to go to court and don't think £250 is worth going to court over but this is about principle and protecting my son as he had enough issues with depression and for a manager to use his weight and mental issues is out of order and then at the first chance they got they kicked him from the squad along with the other lad i mentioned earlier. i spoke with the chairman of teh club on several occasions and nothing was ever done and he never came back to us with any resolution.
i have a recorded call from chatting with the vice chair person and she was clear on the phone that there was issues and that the manager had not used the correct methods to change training and that the u11s should not have trained with u13s along with the other issues mentioned above and that she was going to arrange a meeting between us all to come to a resolution both parties are happy about. the reply from this phone call i got was basically i've done my own inquiries and my conclusion is you are not happy with the manager so pay us the money or we take you to court which is not what was agreed and she hasn't even resolved any of the issues raised
