Just a bit of advice needed really?

We bought our house a few years back. We did our Due Diligence and discovered there had been an issue with the previous owners as to the amount of dust coming from the farm just across the road.

We were aware that it had been kind of sorted by Environmental Health making the farmer grow the hedges taller. They train trotting horses which means they have horse and traps going around a track. The track is just the other side of the hedging.

Over the years we 'tolerated' the dust as it only happened on dry days when the wind blew in our direction. The hedging is very high but doesn't stop it at all. We can't stay outside when it happens, I can't hang washing even behind the property as the dust actually floats all the way across us and over the field behind us and everything gets covered in a layer of fine dust.

Okay! We are nice people and didn't want to cause the guy any problems BUT new neighbours moved in who aren't as tolerant as we are.

My partner, on hearing shouting, went out to find our neighbour in confrontation with the farmer. My partner wandered up hoping to deflate it all but then the farmers son came out to give his twopenneth stating nothing was going to stop him etc etc. Now during this lads arguing something slipped out which made me and my partner really concerned. Previously they had been using crushed seashell for the track but they have now changed it to sand and crushed glass!

Silica sprang straight into our heads. It also worried me as my partner has for a couple of years developed a silly little niggly cough, usually at night or first thing in the morning. I'm not saying it's related but I will say it worried me when we found out they had changed the track surfacing.

Now my main question, which I probably don't stand a chance with, is, the land our house is built on was sold by that very farmer. Does this help us in any way? We are in the process of starting a complaint, which we really didn't want to do but he just will not listen to any kinds of compromise or ideas.

Thing also is, we were hoping to move as we are both getting on now and prefer to be closer to larger communities in case we need them if our health starts to fail. I'm so worried that all of this is going to really affect us and we will struggle to sell. Any thoughts or advice would be gratefully received. If we have to fight then I want to be well armed, if you get what I mean.

    Thanks in advance lovely people.

I think you are right to have concerns about health issues.
I found this article, which while Australian, you might find alarming http://thebeatentrack.org/study/results.html

First up I would make a report to your county council environmental health department, and copy in your local councillor seeking his support.
