  • Britannia parking case

I'm in full time employment and also work privately as a support worker with a gentleman with many ailments and who is in a wheel chair. About a year ago I took him out to the cinema and parked in the car park run by Britannia parking. During the film the gentleman I was supporting felt unwell and had a personal accident.. he was in some distress and my priority was to get him to a place of safety and home so he could get cleaned up. The staff at the cinema helped and let us out of the back door to give him some dignity. I later recieved a parking fine from Britannia and I sent a case explaining the situation fully expecting g that under the circumstances any decent company would take that into consideration.. the reply came back and they dismissed my appeal and put the fine Upton £100.. after contacting them I was told the decision was final and I could not appeal again.. to cut a long story short I've ended up with a court summons from BW legal threatening a CCJ.. obviously I'm at an age where a CCJ would be totally incomprehensible so today I called and made the payment of just under 250.. I stated that I was in NO way admitting liability and my payment was simply to ensure a CCJ would not happen.. the adviser from BW legal told me paying was admitting liability.. I again stated knowing the calles are taped that i wasnt.. I've recieved a letter from the manager of the cinema and the family of the guy i was supporting both clearly stating that the incident occurred and i acted in the best interests if the disabled guy i was looking after..

I'm now fuming and want to Get my money back I paid and also hit them where it hurts by taking them to court.

Would I be wasting my time or is there a decent chance I could win and stand up to these bullies.. after all. All they are interested in is money..

    Cheers in advance

    Hi
If it were me I'd write to BWL & secure a copy of that tape, & I'd reiterate that payment was made under duress.
Imho, it appears it could be a case of associative discrimination.
