  • Im a new member and need help very urgently please

    I recieved a court letter for a parking fine in my name (registered keeper but not driver). Partner been hiding letters and only just seen them in his office. Ive submitted the acknowledge online but need help with the defence. Date on county court claim form is 10 june and i acknowledge on the 2.7.19. I understand i have 28 days rather than 14 but my days are running out quickly and dont want a default judgemnet being made. What do i do. I have no legal knowledge and some of the other examples are very difficult to understand to be honest.

    Particulars of claim.
    The driver of the vehicle with reg xxxx parked in breach of the terms of the parking stipulated on the signage at xxxxx...... The claimant claims £90 for the PCN, £60 contractual costs and statutory interest of £12.67.

    Having spoken to my husband he says he never parked in a bay outside the dental practice but did park on the road and could have possibly have slighly obstructed a parked vehicle in the bay but only slightly.

    Please help with the defence.

    Can i defend on the grounds that he never parked on the landlord property where the contract is for??? He was parked on a main road, which technically is council property (i think)

    Now that you gave acknowledged you have 33 days from the date of issue to get the defence to the court.

    Of course you have a defence that the driver parked on public land. Get on to the council, possibly a web page, to see if the road where the driver parked is adopted.

    As you are the keeper then if it comes to the worst then all you would be liable for Is the initial PCN and not those extra charges. POFA 4 (5).

    Can you show you were elsewhere at the time?

    Have you got a copy of the original PCN to see if it complies with POFA to actually hold you liable? Post it on here withe identifying details removed but leave dates.
