  • Caught shoplifting need advice

    Hi,
    I’m new to this forum and looking for some advice.
    I was caught shoplifting today by a plain clothed store detective in M&S.I am mortified and very ashamed of this.I suffer from depression and anxiety though I am not trying to excuse my behaviour.
    I entered the fitting room and took stuff then noticed guy(plain clothed detective) following me around shop so put items back.
    He then approached me and asked me to come to his office.He gave me a form about trespassing and told me I was banned from store.There will be no civil recovery action as he said technically I didn’t actually leave shop with items.He took my details and also took my car reg.
    I am now worried because I have been caught shoplifting before in another branch and given one of these trespassing letters...it was a few years ago.Can they check and see I have been caught stealing in another branch?Will I be charged with trespassing or burglary?
    Do stores communicate with other branches?
    Also I am too ashamed to tell my husband but what if he drives to retail park..they have our car reg number?
    Grateful for any advice

    Not a very proficient undercover agent if you noted him

    As you returned the goods they would have problems proving theft, unless you admitted your intention was to steal.
    I also doubt that any interview was carried out correctly and so would be inadmissible in any court action

    Was your earlier ban still in force?
    Was it for all M&S stores?

    Vehicle registration probably only taken because its on the form!
    Even if your car is picked up on the retail park's CCTV it shouldn't affect your husband, or anybody else.
    You have been banned from M&S only (?) so there is no reason why you should not visit other stores.
    Other people could use your vehicle, you could sell it.
    Any number of reasons why your car is there.

      Thanks I’m just so worried and thinking about it all the time.
      I read somewhere that if you’ve been banned from one store and go into another and get caught then you can be charged with burglary!!
      Police weren’t involved in either occasion but worried if they realise this is the second time I’ve been caught when I’m meant to be banned then they may contact police.Feeling frantic incase police turn up at my door.Surely they would’ve contacted police at the time
      Not sure if first letter was banning me from all stores or just that particular one but got a feeling it was from all of them.Also not sure how long ban was for either.
      He followed me out and took pics of my car as I couldn’t remember all of reg number when he asked.
      I have been banned from whole retail park as he got retail park security guy over as well which is why I’m worried that they may approach my husband if he goes there though he hardly ever does so shouldn’t be a problem but just worried

        If you return after being banned you are trespassing.
        If they identify you you will probably be escorted from the store as there is little else they can do.
        However if you enter with the intention of stealing and are caught you could be charged with burglary (it doesn't happen very often as charge is usually reduced to theft )

        In your case I very much doubt you will hear more.
        Firstly you didn't actually steal anything as , having noted the store security you returned the goods.
        I actually wonder why they stopped you as they would seem not to have any evidence of theft.
        I also wonder how they interviewed you: probably made such a mess of it that whatever you said or admitted to would not be admissible in court.

        You may have been banned, but not your car nor its occupants.
        If your husband does go to the park there is no reason for him to be approached, and even if he is there should be no mention of your ban.
        To do so would breach the data protection act

        IMO most unlikely that the police will appear on your doorstep
        The cost to the store of reporting it to the police and then supporting a possible prosecution would outweigh any advantage.
