  • Broken Porch potential liabilities

    I share a front garden with my neighbour. My porch is badly broken, it is made of wood and glass. As I am on an exceptionally low income I have not been able to get if fixed, but have used tape to secure as best I can the glass windows. I have recently been getting complaints from my neighbours, who rent their property, about the potential hazard involved (presumably if one of the glass windows falls out.) Can you please explain what my legal position is? Am I forced to ensure that the porch is 'non-hazardous' due to the joint shared garden? Their Landlord is now passing messages through them for me to fix it, but I would like to point out that he used to live their himself, and has a strong tendency to behave like a bully. Any advice about my legal position I would be grateful for.

    If the porch is your property and you are responsible for its maintenance, you could be held liable if anyone (not just your neighbours) is injured by it.
    You might have public liability cover with your house insurance, but the policy will almost certainly require the buildings to be kept in a sound condition.
    If it is reported to your local council as a dangerous structure they may carry out minimal work to ensure safety and invoice you if you do not carry out the work yourself.

    Your neighbours themselves can't force you to make it safe, but you would be wise to take heed.
