  • Received Parking Ticket Whilst Stuck in a Lift

    Hello Beagles, I hope everyone is well.
    A bit of an odd one: I was dropping something off at a friends house, parked in a timed parking bay, got stuck in the lift in their building and when I was released by the lift engineer 90mins later I'd been issued with a parking ticket.
    The parking bay is free until 4pm. I'd parked at 3:25pm and only expected to be gone for 5mins but the lift doors closed and stuck fast. There is an emergency alarm call button in the lift and i pressed it twice, it rang, but there was no response. Luckily I had my phone in my pocket so googled the name of the company on the control panel and they gave me the details of the company that maintains the building and they called a lift engineer and i was released eventually.

    I'd like to know if the management company are liable for my parking fine.

    I'm not laughing.......honest!
    Must have been very irritating, though.

    Imho, no problem.
    Firstly the alleged 'contract' with the parking co has been frustrated by an unforseen event. (Google 'frustration of contract'.)
    Secondly, you may well be covered if your friend has a lease/tenancy agreement allowing them (& visitors) parking rights there.

    Lifts do break down from time to time....part of life's rich tapestry (& loads of Hollywood films.)
    I doubt whether they would be liable for your parking charge.

      Tks for the reply Charity, much appreciated. I was parked on the street, a TfL red route bay. The building managers politely told me to go away and pleasure someone, so I put in a challenge with TfL and will let you know what they say. Dog was pretty peeved too...
