  • Lowell - notice of issue warrant from court

    Hi there,
    I received a warrant issue letter from the County Court regarding a debt lowell have bought. I rang lowell Ltd and managed to get information from them regarding this debt, we'll, what it is for anyways. Apparently its a debt from 3 which I took out over 6 years ago for my brother, that my brother never paid.
    They said they would transfer me to lowell solicitors as I was through to the wrong company. I then hung up because after reading some comments about lowell and debt collectors I thought I would first get some sound advice as to what I should do with this matter.
    I have ready that debts become statue barred father 6 yrs and I've had no contact regarding this particular debt.
    Is this letter legit from the County Court and will they send bailiffs to me even though its been 6+ years?

    If they have a county court judgment then the limitation defence falls away as the judgment means the debt isnt statute barred

        If it's a warrant of control that means they've applied to the court to be able to enforce the judgment With bailiffs. If you didn't know anything about the judgement until you received that letter you could look at either applying to set aside the judgment And suspend the warrant to enable you to defend the case which is form N244 And costs £255 ( see -https://legalbeagles.info/library/ho...-judgment-ccj/ ) Or you can apply to the court to pay the judgement by instalments which is known as redetermination this will also suspend the warrant and the court will look at whether it can be paid by monthly instalments this is form N245 Which costs £50. Of course if you are on a low income check if you are eligible for fee remission ( ex160).

        As PT said if the judgment was obtained within six years of the debts defaulting or last been paid then it won't be statute barred. Time barring ends at the point of judgment.

        btw That you took the contract out for your brother won't be a defence.
