  • Transfer of property

    Hi we would like to know the process of transfer of property from my husbands cousin name to our names. We have been paying mortgage and are planning to pay the mortgage completely off so there is no mortgage on the property. Then my husbands cousin transfers the property to our joint names. Please advise what would be the best way to do it? We need legal advice as we have been paying lots of our own savings into the property and don’t want to risk everything.

    Hi O.Nunn,
    I would suggest that you obtain some legal advice as soon as possible in respect of the best options here. There are a number of factors that will come into play and which could potentially cause issues for you. It is not quite so straightforward as just transferring a property as certain other information is needed for example to demonstrate the property has not been transferred at an undervalue and that all the parties are in agreement etc.
    Do make an appointment with a property lawyer. You may be able to get a free half hour or reduced fee initial appointment just to go through the options and potential pitfalls.
    I am a qualified solicitor and am happy to try and assist informally, where needed.
