  • PCP Car Hand Back charges

    I hope to get an answer to a basic question not covered (I don't think) in the section on Vehicle refurbishment charges. I had the car from new for 4 years. The company I had the PCP with have just written a letter to me OVER 5 months after I handed the car back over to them in December 2018 demanding well over £700. They have not provided any information as to why. The car was taken from me straight to a large auction site and they told me that non of the very minor scuffs and scratches were done before the car was sold at auction on the 28th January, merely valeted by them. I surmise that it was bought by a garage as it was not taxed until 1st April.
    I would very much like to know if there is a time limit (either voluntary or in Law) for asking payment for 'recharge costs' and if so what is it. Also should they have provided a list of these charges and copy invoices of the work done. I don't see how that could be as the auctioneers did no work on the car.other than clean it. I have further info if requested.

    6 years is the limitation period to claim damages.

    Finance co. doesn't need to actually carry out the repairs, the cause of damage which reduces the value is enough. You may, however, be able to argue that they've not attempted to mitigate their losses by auctioning the car when they had an opportunity to obtain a higher price through a dealer or private sale.
