Hi, Can any one help?
Ive been served with a statutory demand under the insolvency act on Friday. Its for a sum that I am disputing. The creditor sent the paper work to the wrong address so I didnt know a CCJ had been issued for it until the court sent the paperwork to the right address to say that they had agreed the CCJ. I filed an N244 to ask for it to be set aside on the grounds of the dispute. I had to complete an EX160 for fee remissions and Ive just sent back the additional evidence they asked for for HMCS to assess that application. The debt is £50k.
I plan to :
a) contact the court on Monday to find out how long the assessment above with take?
b) send an email to the creditor to tell them the contents of the N244 and why I am disputing the CCJ.
c) send the same info to the court that is dealing with the statutory demand in the hope they will put it on hold.
Is this the right thing to do? If not what should I be doing? Will they make me bankrupt if the court dont accept the paperwork. I have nothing so they are fighting a losing battle on the score.
