    Hello lovely people i'm hoping someone can advise me.

    My aunt recently passed away without a Will in place to my knowledge. She had no surviving spouse & had no children. She does however have a surviving sister age 81+ with kids and a deceased brothers kids.

    My question is would the deceased brothers kids have an entitlement. I have looked online and some sites say it would go to the sibling and some also say that the deceased siblings children would also be legally entitled.

    Sorry to hear of your loss.

    Intestacy rules mean:that when a person with no spouse/civil partner passes their estate is inherited by survivors in the following order:
    • Their parents;
    • If parents are deceased, to their brothers and sisters;
    • If they have no siblings or surviving parents, to their grandparents;
    • If grandparents are also deceased, to uncles and aunts;
    • If they have no living relatives, the estate will go to the Crown.

      If you follow that link, you eventually get to the answer to the original question:-

      'If a brother or sister has already died, their children (nieces and nephews of the deceased) inherit in their place.'
