I have been visited by bailiffs today at my home, much to my surprise. I didn't receive any letters from them prior to this.
They seized £12k from me which I have had to borrow from family, due to a claim made against me, asking for repayment of what was a non-refundable deposit for work undertaken by my company - for which I am a director. The (small) claim was made against me, personally, however I have never had the chance to defend this in court. I went to a preliminary hearing where the claimant denied any knowledge of my company. I didn't have sufficient evidence against this at the time so I collated evidence proving the claimant had knowingly traded with my company for many years, and had this ready for my full hearing at the county court.
The hearing was rescheduled due to a lack of staff and I was emailed about this change. I had a letter through confirming the new time, much later.
Upon arrival to the hearing, I was turned away at the door because the court was undergoing refurbishment and all cases were being held at another location about 30 miles away. The security guard mentioned that I'm not the first person to have turned up here today. I asked the administrator present to please record the fact that I have turned up and to let me know if there is to be a new hearing date.
Since then, I have heard absolutely nothing back from anyone. As above, I received no letters through the post despite the fact they said they sent three over a period of a few months.
This claim was originally taken out against myself, but it should have been my company. Those grounds aside, I also have sufficient evidence that supports my defense.
I now wrongly have a CCJ against my name and have been forced to traumatically scrape together and hand over £12k and I am desperately looking for help on how to appeal these unfortunate set of circumstances.
