  • PCP - is this fraud?

    Don't know where to start with this one but really need some help. I went to SEAT at the end of Feb and enquired about an older model of the SEAT Leon and expressed that I was considering my options of returning my current vehicle to Nissan or factoring this into a new finance deal. The salesperson suggested that the best option was the 0% APR option of the newer models so I agreed that I would prefer the slightly better spec of the Leon Dynamic would be the ideal model as it had all the specifications of my current car to help prevent me crashing.

    I paid £100 deposit and to trade in my car, with 0% APR as the deal was ending the next day so I went through my details as he ordered the car on the screen. I then signed the documents and left. The next day I realised the car documents stated that I still had to pay a deposit of £2700, some of which was for returning my Nissan as a part of the deal. I never agreed to a £2700 deposit so I rang the salesperson and asked what the £2700 was for he said some was for the damages and depreciation of the Nissan and £2000 was for a deposit. I told him I didn’t need him to take the Nissan and that I could simply just repair the damages at a garage myself for much less. I asked how much the deal would be if I don’t pay a deposit and responded with £262 a month which was the same amount so I was a bit confused and started to believe he was trying to pull a fast one on us as how can that be?

    I then got a quote from another dealer for the same car SEAT Dynamic and called the salesperson back at SEAT and told him that I no longer wanted the car he had ordered as I had found a better deal. However he nearly matched the deal to include the still 2 years servicing if I provided another £50 so I agreed.

    I then got my Nissan repaired with all the bodywork to give back to Nissan but realised that with all the additional mileage costs, I may as well keep the car as it would have cost too much so I called SEAT and told them I didn’t want the car but they persuaded me to continue with a deposit of £900 for my Nissan and £262 a month so I agreed. Strangely I asked them if the car had parking sensors on it and they said no but would put them on the back (this should already have been on).

    When I finally came to collect my car (besides my details being incorrect, the finance had also changed from 0% to 6.8%, being charged for Gap insurance) I noticed that features were missing like the SatNav. I then got the brochure up on my phone and that’s when I realised that the car they had given me was not the car I ordered in the first place but instead what I had was the basic model of an SE and not the Dynamic that I had ordered which I have the original paperwork for.

    I rang SEAT and told them it was the wrong car as soon as I realised and told them they had obviously ordered the wrong car but they have basically said I didn't order it in the first place until I proved it, I did prove it and now they are saying I must have changed it when I mentioned I had got a different deal from elsewhere which makes no sense whatsoever. I have had over 2 weeks of stress trying to sort this out and SEAT are refusing to give me any contact numbers of anyone in higher authority to sort the issue out. There is no where online as I have checked and called and I have a meeting on Monday with the Manager who after previous conversions I know just wants to protect himself and will be trying to fob me off with they can't afford it and more excuses. Im at a loss!!
