Hello all,
I’ll keep it as brief as possible but here goes...
My rental property(privately owned) is upstairs of a flat that is owned by local council and tenanted by a fairly nice older couple who my tenant has no issues with. The council tenants requested through the council a repair to the communal path so I receive a letter saying the works are optional, would I like to take part at a cost of £XXX, half of the bill. I refused as I felt it didn’t warrant repair and replied on the supplied form stating as much.
A month or so later I get another letter from the council works department stating their “assessor” has now deemed the works mandatory along with a demand for payment of £XXX. Needless to say I again refused. There was no material change to the state of the path from it being optional for repair to it becoming essential for repair. They then repair the path and send me demand for payment. I ignored.
Further letter received today is giving me 3 days to pay up or face possibility of court action, damage to credit rating etc.
Not sure where to turn and really worried that my perfect credit rating is damaged especially as I am just about to start the process of buying a home with my partner, getting a mortgage etc.
Any advice appreciated.
Alistair
Note: Sum involved is trivial, not more than £200. Local authority is North Lanarkshire Council and letter is from their Sundry Debt Recovery team.
