  • Single Justice Procedure Notice for failure to comply with insurance requirements

I have received a SJPN for not insuring a motorbike I sold last June to a BMW dealership. The court paper states the bike wasn’t insured on the 31/10/18 and no payment was received for the subsequent Fixed Penalty Notice. I have no record of ever receiving a FPN!!!
I sold the bike as a part exchange (I have paperwork that can demonstrate this) inJune ‘18, however I lost the V5 slip the dealer had signed but once I found it again (albeit circa 6 months later) I sent the slip in.
How do I plead? What what are hotheadedness fines for this?

If you feel you're not guilty then plead not guilty and you'll be referred to a full hearing in front of the bench where you'll be able to plead you case.

What is the exact offence stated on the form ?

if a vehicle has been sold and DVLA records haven’t been updated there starts a problem.
The MIB data base is updated, and is accessed by DVLA.
I think it is 28 days later a FPN is sent by DVLA to the registered keeper.as there is no record of insurance as required by the Continuous Insurance Enforcement regulations
Generally submitting evidence of proof of sale before the Fixed Penalty Notice (FPN) was issued won't be accepted by the DVLA and the fine will need to be paid ... or you go to court and hope the magistrate is feeling lenient
