  • BW Legal PCN NCP dispute Letter Of Claim

    NCP dispute with changes to parking charges.
    NCP changed the payment method from "pay on exit" to "pay on entry" at our local carpark my wife uses.
    My wife uses the carpark regularly and always paid the fixed all day fee of £2.50 on exit.

    The new system introduced a 2 tier charge £2.00 for 1 hour or £2.50 for all day ( NCP have since scrapped the £2 1 hour charge within weeks).
    My wife inadvertantly only paid the £2 charge on entry, finding the new system confusing ( as did many other drivers).
    NCP subsequently issued PCN which we appealed on Popla , but was rejected.

    BW legal have now issued a letter of claim for the PCN.

    NCP/Popla do not engage or accept mitigating circumstances?
    We feel NCP have caused this problem and cancel the charge.

    How should we proceed ?

    You don't have to accept POPLA's decision.

    It would appear that NCP are tending towards county court claim, so best be prepared.

    Firstly, was the driver at the time of the contravention ID'd in any of the communications with NCP or POPLA? (Just answer Y or N)

    Could you post up pics of any windscreen ticket, the postal notice to keeper (front & rear) & pics of the site signage relevant to the contravention date?
    Redact personal info but leave times/dates visible.

    Did BWL send out a pre-action protocol pack, or was it just an LBC letter?
