  • Claim from insurance company after write-off

My brother's car was written off by the insurance company after a minor crash.
The insurance company took 2-3 months saying they were investigating, came to the house to get kind of a statement etc and came backup few weeks later to say they won't be paying because there was 6 point on his license which was not declared at the time the insurance as taken.
After this he went through DVLA and discovered that the points were given to him for some camera speeding offence in his absence.
Since he was not aware of the points whilst taking the insurance, does he not have a ground to get the insurance pay, even if not the full quoted amount?
Thanks for reading and your response

To get points on a licence the Police need to know the driver? How did they know so the points can be added?

If he was unaware of the points on his licence, he can expect court enforcement to be chasing for the fine that undoubtedly accompanied the points.

I suggest you first find out the background to the points and details from the court.
When that has been sorted you will be able to discuss the insurance problem

Sorry Des but how did the driver get identified so the licence can be endorsed with points?

A whole host of reasons will account for this
If OP does not recognise the place of the offence it could be DVLA making a mistake and giving him someone elses points (ta very much!)
This would account for OP not receiving a fine.
It could be someone using a false licence
I thought this was going to be an MS90 offence which merits 6 points +fine, but if it is just speeding he was going quickly (eg 51 mph in 30 limit)
There have been other similar cases, not just endorsement but revocation of licence without holder being aware for one reason or another.

Best to obtain details of conviction and court from DVLA, and if not recognised quickly arrange a statutory declaration and lawyer
