A few weeks ago my husband heard from his employer that they had received an NIP for him for speeding in their vehicle. They also sent him a copy of the letter they had received regarding the NIP dated 13/02/2019. It stated:"A Notice of Intended Prosecution ... ... was sent by first class post to you on 16/01/2019. To date our records show that we have not received the driver details. Obviously, the employer had somehow missed this first NIP, but responded within time to this one. The alleged offence took place on 01/12/2018.
My husband then received the NIP. He signed and returned it and now he has received the Conditional Offer of Fixed Penalty. We are now aware that he could have challenged the NIP based on the fact that the first NIP sent to the employer who is the registered keeper was not sent within 14 days. My question: Is it too late to dispute this now he has received the conditional offer? Thanks ever so much for any help offered.
