I am looking for some advice as I am being taken to the County Court Small Claims division. Its a long story but basically a contractor who I was talking to about supplying goods for a new house we are building has demanded nearly £10,000 for loss of profits from me because I decide not to proceed with placing an order for his product. He says that I entered into a contract to place the order and I say I didn't. My two main questions are we are at the DQ stage, should I go for mediation to try to make him tell me how he has calculated his loss estimate or is it a waste of time because mediation will not decided if there was a contract or not. Secondly, he sent me an invoice for his loss of profit and subsequently, (and strangely) before starting Court proceedings issued a credit note for the full amount, does this negate his claim without the stress of going to court?
