  • RLP.....a new approach?

    Hi All,

    There was a misunderstanding in Waitrose back in December. Basically I picked up my "click and collect" shopping which I have done every week for the last 2 years. This time however was the big christmas shop. They asked me if I had any other shopping to do while they got my shopping from the back. I said yes and got a few things I had forgotten on my main shop. I put them in the front of the trolley but noticed my big shop was waiting for me to collect at the main desk. I did this first but then forgot to put the extra things through and ended up walking out the store. Got pulled up by two guys. I immediately realised my error. Too late. They took my details and banned me from Waitrose and John Lewis stores. No police called and I was out in 20 minutes.

    Now I have letters from RLP demanding £150. All items were recoverable so this was for "their time". Thanks to you guys I have ignored all three letters so far. However, I received a letter this morning addressed to "the occupier" (see attached) I am obviously going to ignore this too, but thought I would post as I havent seen a letter like this on the Legal Beagles forum. Isnt the fourth letter supposed to be trying to tempt me to settle for a reduced fee? Thank you. Stephen

        Possible breach of data protection there? Not sure why it is address to the occupier if they have verified the details according to your driving licence? If one lives in a household with several individuals (i'm thinking students or house share) then it is possible that someone else may open a letter like this thus disclosing something that may be both sensitive and personal to that individual.

        Secondly, there are other methods of tracing that can be carried out by RLP so there is no justifiable reason for RLP to be writing a letter addressed to occupier and disclosing a personal matter regarding a specific individual.

        I'd be inclined on this occasion to get them to explain themselves and demand a detailed written explanation as to why they are not handing your personal data in accordance with the GDPR i.e. to be collected and used for a specified purpose, should be used to what is relevant and not to be shared with those unless on a need to know basis. I would be minded to say to them that you will report them to the ICO and/or consider taken legal action against them if they don't provide an undertaking that they will comply and refrain from sending letters containing your address to the occupier.

        Use their own methods against them!

          Whilst agreeing with R0b I can sympathise with the OP if he just ignores this new way of RLP trying to pressurise their victims.
          And thanks Stephen P for giving us this new letter which Amethyst might like to add to the scary letters file

            Indeed - it's a strange tactic and seems to be designed to elicit a response.... likely exactly as R0b has detailed.... possibly to make the recipient worried that RLP will inform the DVLA that some kind of offence has been committed re the non change of details on the driving licence and panic about that and thus contact RLP ... I think I would have to ignore it still and sadly and annoyingly think we'll have to wait until someone has reacted to it to RLP to find out what their new tactic is all about. Of course they know they have the right address and name if the driving licence was given as identity so this 'occupier' 'DVLA offence' stuff is a pile of poop and probably against GDPR... it'll come back to bite them on the bum at some point. If we see a few more similar then we could make a report to the ICO keeping the recipients details anonymous. Can't do that with what could be a one off though. Hmmmm.

              I think I’m happy to ignore it. Although, I’m also happy to assist with the data protection route if you get more of these and you need my assistance.

              The previous three letters had my had my name on them correctly. Although each envelope arrived open. They had been sealed with only a dot of adhesive. My skeptics brain says they did this on purpose to get anybody in the house to look at it so I would be embarrassed into paying.
