  • To send Statute Barred letter or not !

    Hi

    The information on this site is invaluable...…….but I do have a bit of a dilemma, I received a letter from Capquest advising that they will be instructing a home visit by Resolvecall Limited. This account goes back I think to 2006. I cannot remember when payments were last made, I have checked all my credit reference files to see if I can find any information but it does not show on any of the accounts either current or historic. My credit files with Experian/Noddle/Clearscore are all in good shape. Should I send a Statute Barred letter ? Also if I do send this and they send evidence of payment/correspondence would this trigger the account being put on to my credit file? Any feedback would be appreciated.

    Resolvecall are just a form of bullying to make you get in contact with the DCA.

    If the debt is over 6 years old then no it can't be put on your credit file again, once its 6 years after default that's that.

    I'd send the statute barred letter to Capquest and add in to tell that you do not expect to be hearing from Resolvecall and that you do not give Resolvecall permission to attend your home for any purpose whatsoever.

          Hi, okay.... I sent the Statute Barred letter on 13 March including the paragraph about not giving permission for Resolvecall to visit my property. I have heard nothing from Capquest but did receive a letter from Resolvecall in the post on Friday dated 27 March saying they would be visiting my property within the next 7 days if I don't call them/or Capquest. What should I do ? Thanks in advance.

            I'd give Capquest a ring and ask if they received your letter, say can they make a note on any account that it is statute barred and disputed as per your letter, and ask them to tell REsolvecall to leave you alone else you will be making a formal complaint.

            It is most likely that Capquests wheels run very slowly so Resolvecall just carry on churning letters out until Capquest get around to telling them to stop chasing you.

            Oh if, on the very teeny tiny chance, that Resolvecall did come to your door, just tell them the accounts in dispute and you don't wish to discuss on the doorstep... and close the door. No need to be rude, but no need to enter into conversation with them either... they have no powers or rights at all and they're just people doing a shitty job who are well used to people telling them to bog off.
