  • Marston Bailiff attended my house with a warrant from the court

    This morning I was woken up by a bailiff at 6.45 am with a warrant issued by Northampton County Court for Dartford Charges. Last letter from Dart charge was on 11th Feb and I contacted them to say that I was not able to pay but will make contact on 15th. on 7th March I received 4 letters from Marston dated 26th Feb for notice of enforcement with a warrant from Northampton court. I was not able to pay the amount plus their £366 enforcement fee.
    I have called Marston to find out when I was taken to court and where were the letter sent to so that I can attend court and they were not able to give me a definite answer. He said he will be attending the house again tomorrow for removal of goods.

    I am so confused of when and how i was taken to court without me knowing.

    Going to Court is an automatic process. Basically you have not responded to any prior notices sent out by the Dart Charge folk - contact by phone will be ignored. It then goes to Court at the Traffic Enforcement Centre and then to Bailiffs.

    Before they attended you should have received a Notice of Enforcement - this incurs a charge of £75, If you do not make contact with them before the date on the letter then it is allocated to a Bailiff to call where a charge of another £235 is incurred. Unless they Take Control of Goods and remove the Goods for sale then they can charge no more. Where the £366 comes from I don't know - if it is written down then please upload a copy.

    There is no automatic right of entry and under no circumstances should you allow them in. They can seize any goods outside - most usually a car because don't forget the Reg No is listed on the Warrant. Therefore any vehicle should be removed well away.
