  • Confused and need help

    Hi all. Back at end of 2016 my wife received Northampton CC defense papers. We returned defense stating no knowledge of debt, and that claimant had provided no evidence to either my wife, nor the court.
    Heard nothing more for about 6 months, at which point claimant sent a bundle of papers including letters sent to wife, purchase printout from original creditors debt manager, a cca printout filled in electronically.
    then in October 2017, a couple of days before being made homeless she received notice of transfer, sent by Watford cc, to Peterborough cc and an application to have stay lifted.
    we responded by telephone, and told to email court to respond to notice of lifting stay. Which we did pointing out discrepancies in the evidence.
    the date that the creditor sales invoice states the claimant bought the debt does not match either court papers, nor the date the claimant stated in letters written to my wife previously. along with just a computer generated cca, I pointed out the claimant had presented a false and misrepresented claim to the court for financial gain.
    we hadn't heard anything back until the new owner of our old rented accommodation forward a letter dated 6th March 2019. It came from Luton cc and claims the judgement was passed because we did not return the defense form.
    Very confused, and need advice.

    Hmmm - there's a similar case on here atm too so maybe one of you will work out what's going on with these courts atm. Give the court a call - if you can't get through to Luton then try Northampton ccbc and so if they can email the case summary ( date of issue, defence, stay, application, directions questionnaires, judgment etc should be listed on their screen) this should help work out why there is a judgment in default when you did file a defence. There may have been documents sent to the old address that haven't been forwarded on to you and something has been missed along the way. A default judgment after defence can only happen if your defence is struck out so there may have been a request to do that in the application ? Do you have copies at all ? Also double check the claim number is the same.

      Only received forwarded letter today. Will have to dig out original paperwork, and as I said, we responded to the Peterborough cc in October 2017 by email. I have 3 emails to confirm.
      NNBC obviously received original defense as claimant went on to send "evidence" some months later.
      when I put the case number into ccj tracking site it says Peterborough court, despite receiving letters from both Watford and luton courts. Our emails were sent to Peterborough court.
      I'll post full details when I've dug out papers, and post emails.
