  • Obtaining power of attorney

    Help needed for a good friend, A friend of wifes has had a mild stroke not to serious now her daughter is pestering her to allow her to get power of attorney we think the motive is to take money and control over her in a bad way daughter is evil and money grabbing.
    Can anyone offer advice as to whether she needs to see a solicitor and if anyone can stop it happenning

    All she can do is to tell the daughter to stop pestering.
    If the donor doesn't sign the form the daughter won't get the PoA
    She could grant her daughter PoA jointly with another person, so they would have to act together. (not jointly and severally).
    If that other person is strong willed enough they will be able to protect your friend's interest.

      I would say it is probably best for your friend to deal with this sooner rather than later as in the event they were to lose capacity then they would have no say over the attorney and daughter could apply to be made Deputy. Any attorney or deputy has to act in the donor's best interest but dealing with attorneys that don't is time consuming and stressful. Often the damage is already done by then so I would always say appoint someone you would trust with your bank details and that you know would do as you wished if you were able to make the decisions yourself.
      You can set up a Lasting Power of Attorney yourself provided you have capacity to do so. Maybe your wife could have a look on line and have a chat with her friend about it? Here is the link:- https://www.gov.uk/power-of-attorney
