  • Gemini Parking Solutions County Court action over unpaid parking ticket

    Can anyone help.

    My son has received this whilst away at University. County Court Claim. See attached

    His car was parked outside his school friends house on the Cator Estate in Blackheath Park London SE3 (private estate) on 13/9/2017.

    He does not recall a ticket nor any correspondence from this company "Gemini Parking Solutions".

    Any advise on completing the online claim would be much appreciated.

    Hi

    First & foremost, it is important to acknowledge the claim .
    You have 19 days from the issue date on the claim, (14 + 5 to allow for delivery of the court claim to you.), so no panic, but best get it done asap.

    Once you've sorted that, let us know (on this thread) & we'll see about tackling the actual claim.

      Once you'v sorted that, let us know (on this thread) & we'll see about tackling the actual claim.
      Nb If you file the acknowledgement by post, allow a few working days for delivery.

          Did you receive a pre-action protocol pack from either Gemini or Gladrags (letter threatening court action together with a form to return, income/expenditure breakdown etc.) before the claim was issued?

          Any other letter?

          Have you been in contact with either Gemini or the sols?

              Ok, so that's toilet paper really.

              Just if's & and's.

              Do NOT contact DRP.....they are just debt collectors.

              2 options

              1/ ignore the letter.....it is not a letter before claim

              2/ Get ready for 'battle'! (Which is what I would do!)

                The battle has already started, they have the claim form from Northampton. That letter in post #6 was DRP "borrowing" Gladstones letterhead to try and frighten people into paying. Note who the payment is to be made to.

                A SAR to gemini to get any documents from them that concern him. The original PCN would be extremely handy.

                A letter to Gladstones requesting, in order to narrow the issues between the parties as expected by the courts, copies of all the documents that they intend to use in court, including evidence of signage that was there at the time. As the documents would be in their possession in order to perform due diligence before the issue of the claim you expect those documents to be received within 7 days.

                What details are on the V5 document for the car? The correct details or is it an old one and it hasn't been changed?

                Is the place where the car was allegedly parked part of a private residence? Can the school friend get photos of the signs that are currently there?

                  I did mean ignore the letter, not the court claim (that must be dealt with as a priority.)

                    My son said no ticket was left on the car.

                    The car was park on Fox's Dale a private road on the Cator Estate. Outside of his friends parents house.

                    The only correspondence has been the Gladstones letter and the Court papers.

                    The car is still registered to my son at his mothers home address in London whilst he is away at university in Leeds. The car in left in London.

                    Can you direct me to any templates I can use to help his case?

                      Just trying to get the basic details of what has happened before suggesting anything. There are no templates as each case is different.

                      So why were there no letters to the registered address? Did the claim form also go there?

                      need to write those letters ASAP

                        SAR both Gladrags & Gemini, asking for all data concerning this incident.

                        SARs are FOC....keep copies & get proof of posting.....your son will need to sign these.

                        If you have the PCNs, could you post them up here?

                        Also, pics of the site signs..

                          ok.

                          no PCN was left on the car.

                          no other mail was received regards this PCN.

                          I will do a drive by tomorrow and post the pictures of any parking notices the weekend.

                              Ok, we'll have to wait for the SAR replies, then.
                              You can also send a *CPR 31.14 request to Gladrags....ask for copies of all evidence their client proposes to rely on in court, including (but not limited to
                              A true copy of the agreement between the landowner (or the landowner's autgorised agent), & Gemini which allows Gemini to operate on the relevant land.
                              Relevant copies of the site signage.
                              All documentary evidence relevant to the court claim (ie inc PCNs, correspondence from Gemini re this alleged incident, etc)
                              That should do it.

                              If poss, don't rely on them sending a copy of the actual site sign.....they often just send file copies of sign in bright, neat condition.
