    Hi all,

    I’m hoping that someone can help please.

    I received a letter from Mortimer Clarke in December 2018 saying that I owe £10,000 for an old Black Horse debt and that I should fill out an income form and send it back within 14 days.

    I know that I defaulted on the debt in 2009 so concluded that the debt was Statue Barred so replied stating this.

    They then replied in January 2019 stating that the debt went to a CCJ in June 2010 and therefore can not be Statue barred.

    I have now replied stating that I believe that they should have enforced the CCJ within 6 years and to continue enforcement they would need to apply to the court and that I believe they are unlikely to be successful.

    I would like to briefly explain why I defaulted and why I didn’t know about the CCJ.

    From 2007 to 2009 I was a self employed plumber, I was subby bashed by a company for around £6000 and got into financial trouble, I gave up sole trading and sub contracted for a good company, my relationship broke up as a result of the difficulties and I found myself homeless from 2009 to early 2013. I then got my life back together and met an amazing woman, now my wife.

    I work on the books for the plumbing company and earn good money. I repaid £10,000 I had borrowed from my parents and then saved in anticipation of my old debts catching up with me as I was now back on Grid. In 2014 I was contacted by Lowell with regard to three outstanding debts which I settled. I thought by 2015 that any old debts from 2009 would be statue barred. I then got married and bought a house. I was very happy and getting on with my life. Had I been contacted in 2014 I would have settled the debt, do I have to pay it now?

    Any help would be appreciated and apologies for not really being brief,

    When does a CCJ become statute barred?


    It never does. But if the creditor hasn’t taken any enforcement action in six years, they will need to apply to the court for permission if they want to enforce the debt by using bailiffs.
