  • Hello from worried dad! Can the ex move away?

    Hi all,

I've just been dragged through family court to formalize the child care arrangements.

    It stands at:
    1. Every Wednesday night taking into school in the morning.
    2. Sat and Sun every other weekend taking them into school in the morning.

This is very close to 25% and it's been this arrangement for nearly two years, with me having some extra nights.

We agreed 50/50 in Mediation before the case but she changed her mind and I have work commitments so the existing arrangement is convenient for me.

I'm worried that when the ex finishes Uni she'll decide to move away with the boys and demand it from the court.

    Could she?

    Thanks.

    Hi Theboysdad,

It's good contact is happening and seems to be working for you at the moment.
When you say move away, how far are we talking and what would be the reasons?
IF your ex made an application to the Court under the Children Act then they would again be looking at the welfare of your children before making any decision, so it will very much depend on the reasons for the move, what alternative child arrangements can be made for seeing them as well as the childrens wishes if they are of an age to make a decision.

You may be worrying unnecessarily at the moment but if you can keep the lines of communication open it is always preferable then you can sensibly discuss arrangements for the future.
I am a qualified solicitor and am happy to try and assist informally, where needed.
