    If my name is on the mortgage am
    I legally entitled to access the house for my belongings?

      Normally yes, but there may be a lawful reason why not such as an Occupation Order or Restraint Order

        Hi Gemlou81,

        As others have already indicated technically if you are named as an owner of the property then you have as much right to access as the other. However practically it may not be wise. It depends on the circumstances to be honest as Nibber has indicated. In addition it is always sensible to try and do things reasonably in the first instance, so writing to the other owner, confirming what you wish to get from the property for example and providing some dates when you would like to attend to collect.

        If locks have been changed you are entitled to a set of the new keys, but I would advise caution in just showing up and letting yourself in on a principle.

        If things do deteriorate to the point the Court has to become involved it will always be better for you if you can show you have acted reasonably throughout rather than forcing your 'right's when it is clear relations have broken down and the thing that is needed is a plan how to extricate yourselves from the situation not add fuel to the fire so to speak.
