  • Parents PCP headache.

    Good Morning, this is my first post.

    I am looking for some advice with a PCP contract which my mother took out for my sister whom then decided to is disown the car.

    In summary they have fully paid of the whole contact now in that they repaid the amount on the contract for the time specified. however they have now given the car back and in return have received quite a hefty bill.

    there is approx £1000 in over mileage. At 6p per mile.
    And approx £1000 In repairs to the vehicle. My dad bumped it into a lamppost and got it fully repaired before returning it.

    they are now saying that the repair was substandard and will require £1000 to repair.

    They are are now stating my parents have 14 days to pay in full.

    This is is impossible as they simply don’t have the money and are intending to ring the company and tell that they will have to take them to court ?

    Any my advice would be much appreciated.

    When you say your mother fully paid for the contract, do you mean paid all the instalments and then returned the car? If that's the case then I'm afraid there's nothing your mother can do about the excess mileage charges. If she had terminated the agreement earlier via the voluntary termination process she could have mitigated that risk.

    As to the bumper damage, on what basis are they claiming it is substandard? Your mother's duty is to take reasonable care and do what is necessary to look after the car which includes getting it repaired if there is damage. If she went through insurance and got it repaired by one of their approved garages, she should be fine but if it was a back street garage and its clearly obvious that the bumper repair was a hash job then that's a different story.

    You mother can look to going to court over it but unless she exercised her voluntary termination right, there is no leg to stand on in relation to excess mileage, unless she can argue that the pence per mile charge is unfair and too high - somewhat a difficult task.

    She could ask to pay by instalments on the excess mileage but dispute the bumper charge?
