    Hi, my ex was arrested and charged with domestic battery. I will be giving evidence in court in future. Just worried because he father of my baby.
    When the police arrested him they asked they if i knew where his passport is, he is African been here about 7 years but been illegal most of the time. I gave them his passport, now the chief of immigration has the passport. What does this mean?

    Sorry to hear of your problems.

    Concerning your ex and assuming you and your child are British citizens the case of ZH (Tanzania) v. Secretary of State for the Home Department [2011] UKSC 4. is probably to the point.

    In this case it was the mother who was the illegal immigrant, but it was decided she should be allowed to remain in the UK

    It would be foolish though to think this might be the only outcome, but almost certainly he will have to fight removal from the UK
