Hi Legal Beagles, I have been in dispute with Lowells since 2016 when they purchased an old Argos debt of mine, The account was due to become statute barred in a few months and they have now issued proceedings and I could do with some advice. They maintain that they have previously forwarded to me a copy of the original CCA and accompanying documentation as required by the Courts but I don't think they have. What they have sent is a copy of a completed application form (containing all the usual details such as name, address, date of birth, how long at current address, occupation, bank details etc), a set of terms and conditions (undated) and the attached document. Is this a CCA? I thought a CCA had to include interest rate, amount of credit etc. etc. Also Lowells haven't let me have a Notice of Assignment or full details of charges added to the account which I have requested on numerous occasions. Would you advise that I come to some sort of payment plan or defend the claim? Any advice would be gratefully appreciated.
