  • MCOL claim errors

    A bit of advice needed. I submitted a claim against a holiday company about injuries to my two children and loss of enjoyment while on our holiday. Unfortunately, I made the claim in my name ‘as lead contractor’ and submitted using MCOL. The holiday company have defended claim in full, correctly, saying that personal injury should not use MCOL and the claim cannot be in my name. My choices are to try to amend the claim using N244 form. Can the judge make these sorts of amendments of adding new claimants to claim and moving it over to ‘paper’ from online. I don’t know. My other option is to discontinue the claim and then resubmit a ‘new’ claim which may need the judges permission to do and the claim maybe generally the same as the original? I really don’t know which my best option is.
