  • Neighbour moved boundary fence without consent

    Hello
    My neighbour has removed a number of my shrubs and trees, as well as an existing boundary fence and erected a new fence without my knowledge or permission. She has land grabbed off me - about a meter all the way down my garden. She claims she had a survey done and has only moved the boundary to reflect land registry records, however the previous boundary had been in situ for well over 15 years but clearly had not been registered with the land registry. I bought the property in May 2015 and no solicitor nor surveyor flagged that the Land Reg plan was different so I have paid for land that I have ended up losing.
    What can I do? My neighbour has acted maliciously in the past (including refusing to pay vets bills when her two dogs attacked my elderly cat in my own back garden), and she installed CCTV to spy on and intimidate me (the Police subsequently told her to take the camera down as it was illegal what she was doing) and I believe her hatred of me has spurred this land grab - I say this as she has quite unnecessarily grabbed a small triangle of my border that she can’t do anything with, and the fence now springs out of the middle of a wall rather than starting in line with it! It looks dreadful!
    My neighbour carried out the work when I was away so I was unable to stop it going ahead, and she only shared her survey with me two days after works were completed?
    What can I do? I do have lots of photographs showing the original boundary and all of the trees/shrubs that she has ripped out but am I powerless to do anything now that the new fence is in situ? Is there any come back on the person I bought the property off/estate agent? Was it mis-sold to me? I don’t know where to start. I should add that my neighbour is wealthy and she knows that I’m not so she knows she’s got me by the proverbial short and curlies.
    The situation has caused me a lot of stress and has left me depressed and wishing that I could just move away, so thank you for any advice that you can offer.

    I guess you would have to look at your original property plan to prove that your neighbours development has trespassed onto your land. With regards to cctv the police were correct to act under the privacy act. If you have proof that your cat was attacked in your garden by the neighbours dogs, then I would imagine that you would have a case if you have the evidence to prove that the dogs were there.

    when you bought the property, I assume that you would have been given the map of what you own, to include the land around it.
    have you checked the land registry with regards to what your neighbour is saying that they have acted on what lawfully is theirs, and altered things accordingly.
